Gumbleton, Edward, late of Euchareena

This is the last will and testament of me Edward Gumbleton of Euchareena in the state of New South Wales grazier I revoke all prior wills and testamentary dispositions heretoforemade by me I appoint Leslie Robert Smith of Shepherds Creek Euchareena aforesaid grazier and Michael Alphonsus Casey of Orange in the state aforesaid Solicitors (herein after called my said trustees) to be the executors and trustees of this my will and I hereby declare that all the trusts and powers herein after vested in my said trustees may be exercised by the survivor of them or other the trustees or trustee for the time being of this my will I give and bequeath the following pecuniary legacies free of probate duty payable on the determination of the life estate or interest hereinafter devised and bequeathed in favour of my wife Annie Elizabeth Gumbleton that is to say To the Roman Catholic Convent of Stuart Town in the state aforesaid the sum of twenty five pounds for the general purposes of the said convent for which sum the receipt of the superior of the said convent shall be a sufficient discharge To the trustee or trustees of the Roman Catholic Church at Euchareena aforesaid the sum of twenty five pounds for the general purposes of such church To the Right Reverend Monsignor Long of Wellington in the state aforesaid the sum of ten pounds for masses for the repose of the souls of myself and my said wife To the Reverend Father Parker of Wellington aforesaid the sum of ten pounds for masses for the repose of the souls of my self and my said wife To my nephew William Gumbleton the sum of two hundred pounds To my niece Louisa Nancarrow the sum of one hundred pounds To my nephew Ernest Gumbleton the sum of fifty pounds To my nephew Albert Gumbleton the sum of fifty pounds To Norah Cootes of Cavendish Street Stanmore in the state aforesaid widow the sum of fifty pounds To Rose Gressein[?] of Orange aforesaid nurse the sum of one hundred pounds To Mary Ann Frances Gressien[?] daughter of the said Rose Gressier the sum of twenty five pounds To Agnes May Gresseir the daughter of the said Rose Gressier the sum of fifteen pounds To Charles Dominic Gresseir son of the said Rose Gresseir the sum of fifteen pounds To Daus Elizabeth Edge the wife of Robert Edge of Forbes in the said state coachbuilder the sum of twenty pounds To Edward McClaskey of Newcastle in the state aforesaid the sum of fifty pounds To Frank Clarke and Norah Clarke children of the said Norah Cookes by a previous marriage the sum of twenty pounds each To Frederick Carlin Ivy Carlin and Richard Carlin who have resided with me at Euchareena for some time past the sum of fifty pounds each and I declare that the respective legacies of any of the herein before mentione legatess who shall be minors at the time of my death or of the death of my said wife which ever shall last happen shall not be payable to said respective minor legatees until they respectively attain the age of twenty one years but that in the meantime my said trustees may set apart a sufficient amount from my estate to pay such legacies as and when they become payable and invest the amount of each such legacy in any investment authorised by law for the investment of trust funds and accumulate the same at compound interest during the minority of the person entitled to such legacy I give devise and bequeath the whole of my estate real and personal of what soever kind and wheresoever situate unto my said trustees upon trust to sell call in and convert into money the same or such part thereof as shall not consist of money with power and full discretion being said trustees to postpone the sale calling in and conversion of the whole or any part of my estate during such period as they shall think proper without being responsible for any loss and to stand possessed of my said ready money and the proceeds of said sale calling in and conversion and such part of my estate as shall not for the time being be sold called or converted upon trust after payment thereof of my just debts funeral and testamentary expenses to pay the income thereof to my said wife during her life and from and after her death upon trustto pay the funeral expenses of my said wife and thereafter the pecuniary legacies herein before or by any codicil hereto given and bequeathed and to pay or divide the residue of any to or between my said nephews William Gumbleton Ernest Gumbleton and ALbert Gumbleton and my niece Louisa Nancarrow the children of my decease brother John Gumbleton in equal shares share and share alike And I declare that if any of them my said nephews and niece shall die in my lifetime or the lifetime of my said wife leaving a child or children living at the death of the survivor of myself and my said wife such child or children attaining the age of twenty one years shall take or if more than one equally between them share which his her or their parent would have taken under this my will if such parent survived me and my said wife And I direct that my said trustees shall be intitled to charge against my estate as part of the funeral expenses of myself and my said wife the cost of erecting a tombstone or tombstones on our grave or graves with coping and pailing and according to such specifications as my trustees shall think fit at a cost not to exceed one hundred pounds And I declare that the said Michael Alphonsus Casey shall be entitled to make and receive all such charges and emoluments for business done by him in relation to the administration of my estate or the execution of the trusts of this my will or any codicil hereto as he would have been entitled to make and receive in respect of such business if he had not been an executor or trustee hereof In witness whereof I have hereunto subscribed my name to this my will this first day of December one thousand nine hundred and twelve. Signed by the testator as and for his last will and testament in the presence of us both being present at the same time who at his request in his sight and presence and in the sight and presence of each other have hereunto subscribed our names as attesting witnesses and the words "determination of the" being interlined on the tenth line of the first page hereof and the word "dispositions" being struck out on the twelfth line of the second page hereof and the word expenses substituted thereof prior to the execution hereof. 12 May 1913 On this date Probate of the last will and testament of the said deceased was granted to Leslie Rowling Smith (in the said will called Leslie Robert Smith) of Euchareeda grazier and Michael Alphonsus Casey of Orange solicitor the executors named in the said will Testator died at Euchareena 1 March 1913.
